Terms and Conditions

 

  • Definitions

 

 

“Working Day” – means Monday to Friday, excluding public holidays.

 

“Normal working hours” – means 9:00am – 5:00pm on a working day.

 

“Out of normal working hours” – means time outside of normal working hours.

 

“Neptune Design”- means Neptune Design (Pty) Ltd (registration number 2017/335487/07).

 

“Guarantee Period” – means the period of time for which the Money Back Guarantee is available and is specified further under the Money Back Guarantee clause below. 



 

  • Service delivery and Improvements

 

 

2.1 Neptune Design seeks to ensure that the services provided to its clients are satisfactory at all times and aims to deliver all services with reasonable care and skill.

 

2.2 In order to improve the services provided, Neptune Design welcomes any comments that any clients may have, to be emailed to feedback@neptunedesign.co.za 

 

 

  • Commencement of service

 

 

3.1 Website, graphic designing, marketing and coding services will commence only once

Neptune Design has received at least 50% deposit of the contracted fee, or the full

contracted fee thereof.

 

3.2 All support services will commence only once the full contracted fee is received by Neptune Design.

 

 

  • Payment 

 

 

4.1 Neptune Design shall invoice the client before the service provided is completed. All payments to Neptune Design for services shall be made against the invoice which shall be presented during or after the period of the provision of services in respect to the services provided by Neptune Design.

 

4.2 All payments must be paid by the date specified on the invoice for payment due. If payment is not made by the due date specified on the invoice, Neptune Design will be entitled to charge interest on the outstanding balance.

 

 

  • Interest

 

 

5.1 Neptune Design shall be entitled to charge interest at the rate of 5% per month on all overdue amounts outstanding for more than 30 days from the date specified on the invoice.

 

5.2 Neptune Design also reserves the right to increase the interest rate, which the client will be notified of such increase at least 30 days before it is due.

 

5.3 Interest will be calculated on a monthly basis.

 

 

  • Overtime

 

 

6.1 All clients must note that Neptune Design’s working hours are as follows:

Monday – Friday: 9:00am – 5:00pm

Saturday: Closed

Sunday: Closed

Public Holidays: Closed

 

6.2 The following conditions apply to all forms of communication:

Any communication, including queries, correspondence and work done out of normal working hours will be charged at an additional rate of R450.00 (FOUR HUNDRED AND FIFTY RAND) per hour.

 

6.3 All clients who do not have support contracts or whose support contracts have expired must note further that:

 

6.4 Any communication, including queries, correspondence and work done during normal working hours will be charged at a rate of R450.00 (FOUR HUNDRED AND FIFTY RAND) per hour; and 

 

6.5 Any communication, as mentioned above, done out of normal working hours will be charged at an additional rate of R450.00 (FOUR HUNDRED AND FIFTY RAND) per hour.





7.Social Media Marketing Lead Generation

 

7.1 All clients who use this service must have a registered business. 

7.2 Any work relating to this marketing campaign will only commence once funds have been cleared and received in our bank account. Clients will be notified when such work will commence. Please note further that proof of payments will not be sufficient in this regard, unless the payment has been instructed to reflect immediately by the payer’s bank.

7.3 It is the client’s duty to ensure that they have the necessary commercial rights to use any images, documentation or media supplied to Neptune Design for the marketing campaign.

7.4 All leads received by any client are confidential and must be respected and treated as such. Clients cannot resell the information provided in the leads nor can they harass the subjects of the leads nor use the leads details for any other purpose other than for communication regarding the product for which they have originally enquired about.

7.5 Neptune Design is not obliged to handover any designs or web pages created for the purpose of collecting leads. All designs will be stored or destroyed on completion/cancellation of the marketing campaign.

7.6 Neptune Design will dispose of all lead information within 60 days from the date of commencement as specified in 7.2 above. It is the responsibility of the client to record this information. 

7.7 The client will also bare any liability if there is any abuse of any private information.

7.8 All leads will be supplied during “normal working hours” as indicated in the definitions above.

 

7.9 Neptune Design does not qualify leads via a call centre or through telephonic scripting, all our business processes are automated. By using the service you acknowledge this process. 

 

7.10 Neptune Design has the right to cancel any marketing campaign by giving 30 days notice, due to unethical behaviour by the client, industries that create a negative brand association or the marketing campaign no longer being profitable to market forces. 

 

7.11 Neptune Design does not guarantee sales from any leads and this is not a ground for a refund under our money back guarantee clause provided below.




8.Money Back Guarantee

The following restrictions apply to products which specifically are covered by the money back guarantee. Please note further that any non-compliance of these conditions will render the guarantee void.

8.1. The money back guarantee on the Social Media Marketing Lead Generation campaign will be valid only for the Guarantee Period which is subject to a maximum period of 30 days. No refund claims outside of this period will be considered.

8.2 The Guarantee Period will commence monthly after payment has been received by us, and at such time the client will be notified when the campaign has commenced. The client will be eligible to claim their money back when such notification is received by them. 

8.3 In order for the client to claim their money back, they must simply submit an email to support@neptunedesign.co.za indicating their intentions and reasons for claiming their money back, with their company’s full banking details.

8.4 Any refund by Neptune Design will take up to 10 working days from the date the email was received as referred to in 8.3 above. Such refund will be effected via EFT to either the original client company or the owners of the client company whose banking details will be provided as referred to in 8.3 above. 

8.5 Neptune Design reserves the right to forfeit the guarantee if we suspect any abuse of our money back guarantee offer.




  1. Privacy Policy

 

9.1 All privacy policies supplied will be in line with the General Data Protection Regulations and is, however, just a basic generic policy. 

 

9.2 Neptune Design advises clients to seek professional legal counsel to ensure that the privacy policy provided is fully compliant and in accordance with the laws in the country in which it operates and applies to.

 

  1. Termination

 

10.1 Cancellation or termination of any service provided/undertaken by Neptune Design may be made at any time subject to the following conditions:

 

10.2 Should any client cancel their contract before its mid-term is reached, such client shall be entitled to receive 50% of the contracted fee, already paid by such client.

10.3 In respect of all support contracts, 50% of the full contracted fee paid; and 

10.4 In respect of websites, graphic designing or coding services, 50% of the deposit or the full contracted fee already paid by such client.

 

  1. Hosting

11.1 All hosting contracts will be paid in advance before any hosting commences.

 

11.2 Should any hosting invoice due be unpaid the account will immediately be placed

into suspension.The suspension will only be lifted once a minimum reconnection

fee of R500 (Five Hundred Rand) is paid this fee can also be increased if the

invoice is due for longer than 30 days.

 

11.3 A Migration fee of R476 (Four Hundred And Seventy Six Rand) will be charged to

all clients who wish to move their hosting account to another hosting provider.

 

11.4 In the event that a client’s domain should expire because of failure to pay the

domain renewal fee ownership of that domain will be immediately relinquished.

After being relinquished any domain registrar will be able to resell the domain at

a price they wish. Neptune Design Pty Ltd will under no circumstances guarantee

the price of a domain that has been relinquished.

 

  1. General

 

12.1 All queries related to support are to be emailed to support@neptunedesign.co.za This includes, but is not limited to, website; email; hosting; branding; and marketing support queries. 

 

12.2 All contracts for the provision of services provided by Neptune Design shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the client.

 

12.3 All aforementioned prices will be transferred to the equal amount in currency of the country or territory which the client resides in.

 

12.4 Neptune Design reserves the right to update and make changes to these terms and conditions at any time without prior consent of its clients or any other third party involved.
